Acceptance of terms
Welcome to PestHalo. The website pesthalo.com (the "Site") and the products sold through it are operated by Everwave LLC. The terms "PestHalo", "we", "us" and "our" refer to PestHalo, a brand operated by Everwave LLC. By accessing the Site or placing an order, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
Eligibility & account
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. You may create an optional account to manage orders and shipping addresses. You are responsible for keeping your login credentials secure and for all activity under your account. Accounts cannot be transferred to others.
Products & pricing
We make every effort to display products and prices accurately. Colors, finishes and product photography are reproduced as faithfully as possible but may vary slightly from the physical item. Prices are displayed in the currency selected at checkout (USD, CAD, GBP or AUD) and are subject to change without notice. Promotional pricing applies only while displayed and may be limited per customer.
We reserve the right to refuse or cancel any order in cases of suspected fraud, pricing errors, or stock shortages.
Orders & payment
Placing an order constitutes an offer to purchase. All sales and purchases made on the Site are made directly with Everwave LLC. We will confirm acceptance by email once payment has been processed. Payment is collected at checkout through our payment processors (Shopify Payments, PayPal, Shop Pay, Apple Pay, Google Pay and others displayed at checkout). You authorize us to charge your selected payment method for the order total, including taxes and any shipping upgrade where applicable.
Orders can be modified or cancelled within six (6) hours of being placed. After that, the order is handed to our fulfillment partner and any change is handled under our Return & Refund Policy. Purchases are for personal use only; resale of PestHalo products without our written authorization is prohibited.
Shipping
Orders are shipped from our fulfillment centers to the United States, Canada, the United Kingdom and Australia. Standard shipping is free on all orders. Delivery times are estimates and not guaranteed. Risk of loss and title for purchased items pass to you upon our delivery to the carrier; confirmed lost orders are reshipped at no charge as described in our Shipping Policy, which is incorporated into these Terms by reference.
Returns & refunds
Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. In short, PestHalo is backed by a 90-day money-back guarantee — no return shipping required.
2-year warranty
Every PestHalo unit is covered against manufacturing defects for twenty-four (24) months from the date of delivery. Warranty claims must include the original order number. The warranty does not cover damage caused by misuse, modification, accidents, water exposure, or normal wear.
Intellectual property
All content on the Site — including text, graphics, logos, product photography, videos, software, and the PestHalo™ name and trademarks — is owned by Everwave LLC or our licensors and is protected by US and international copyright, trademark, and other intellectual property laws. The PestHalo name, logos, product names, designs and slogans are proprietary branding of Everwave LLC. You may not reproduce, modify, distribute, or create derivative works from any of it without our prior written permission.
User content
You may submit reviews, comments, photos and other content ("User Content") through the Site, by email or on our social channels. By submitting User Content, you grant Everwave LLC a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, modify, publish and display that content in connection with our marketing and the operation of the Site. You represent that you own or have the necessary rights to the User Content you submit and that it is accurate. We have no obligation to keep feedback confidential or to compensate you for it.
Prohibited uses
When using the Site, you agree not to:
- Violate any applicable law or regulation;
- Infringe upon intellectual property rights;
- Submit false, misleading, or fraudulent information;
- Upload viruses or malicious code;
- Attempt to gain unauthorized access to the Site, other accounts, or our systems;
- Use the Site to harass, abuse, or harm others;
- Resell PestHalo products without our written authorization.
We may suspend or terminate your access without notice for any violation.
Relationship with Shopify
The Site is hosted on Shopify. Your purchase is made directly with Everwave LLC, not with Shopify. To the extent permitted by law, you release Shopify and its affiliates from any claims relating to your purchase or use of the Site. Personal information is handled in accordance with our Privacy Policy and Shopify's Privacy Policy.
Disclaimers
The Site and products are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in our Return & Refund Policy.
PestHalo is designed as a deterrent device, not a guaranteed extermination solution. Results vary based on environment, severity of infestation, and proper use (one unit per room, plugged in continuously). For severe infestations, we recommend consulting a licensed pest-control professional. PestHalo is not recommended in homes with hamsters, gerbils, rabbits, guinea pigs, birds or reptiles. If you have an implanted medical device such as a pacemaker, consult your doctor before use.
Limitation of liability
To the fullest extent permitted by law, Everwave LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site or products. Our total aggregate liability for any claim related to the Site or products shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Everwave LLC, Shopify and their respective affiliates from any claim, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your User Content, or your violation of any law or third-party right.
Governing law
These Terms are governed by the laws of [STATE / COUNTRY OF EVERWAVE LLC'S HEADQUARTERS], without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in [JURISDICTION], and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer rights you may have in your country of residence.
Severability, waiver & entire agreement
If any provision of these Terms is found unlawful or unenforceable, it shall be severed and the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with the policies referenced herein, constitute the entire agreement between you and us and supersede any prior communications. You may not assign your rights under these Terms without our written consent; we may assign ours freely.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
